1. INTRODUCTION
Spirent Communications (we or us) is committed to protecting and respecting the privacy of its users.
This document sets out the basis on which any personal data that we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we treat it.
For the purpose of the Data Protection Act 1998, the data controller is Spirent Communications, Inc., Attn: Umetrix Product Management, 5280 Corporate Drive, Suite A100, Frederick, MD 21703, USA.
This Mobile Application Privacy Policy (the Policy) applies to your use of:
1.1. any of the mobile application software that may be accessed through https://play.google.com/, once you have downloaded or streamed a copy of an App onto a mobile telephone or handheld device (the Device); and
1.2. any of the services accessible through the Apps (the Services) that are available on any sites of ours.
This Privacy Policy applies only to information we collect at and through Spirent Umetrix tools. Our website and other affiliated sites may be governed by their own separate privacy policies which are set forth therein. Please be aware that we are not responsible for the privacy practices of third party sites that are not owned or controlled by Spirent, which may be accessed via Spirent Umetrix tools. We encourage you to be aware when you leave Spirent Umetrix and to read the privacy statements of each and every website that collects personal information.
2. COLLECTED INFORMATION
2.1. Information We Collect from You
If you download, install and activate a Spirent application on your wireless device/ smartphone, we will collect information from you during the activation process and/or each time you run a test. This information includes:
Location information
GPS latitude & longitude
GPS satellite PRN & SNR
Wi-Fi SSID*, BSSID*, RSSI*, & EARFCN*
Phone information
Phone number
IMEI
Cellular RSSI
Telephony bearer
Data bearer
Cellular RAT, carrier, MCC, & MNC
Bytes sent & bytes received
Battery health, level, & temperature
Android hardware Serial Number
2.2. Information Collected Through Google Analytics
We use a tool called “Google Analytics” and may use other third party analytic tools to collect information about use of Spirent Umetrix. Google Analytics collects information such as how often users visit Spirent Umetrix and what pages they visit when they do so. We use the information we get from Google Analytics only to improve Spirent Umetrix. Google Analytics does not collect your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your device to identify you as a unique user the next time you visit Spirent Umetrix, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your usage of Spirent Umetrix is restricted by the Google Analytics Terms of Use and the Google Privacy Policy.
2.3. No Information from Children Under Age 13
If you are under the age of 13, please do not attempt to register with us at Spirent Umetrix or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information. 3. HOW YOU CAN CONTROL WHAT INFORMATION WE COLLECT
Location information will not be collected from your device unless you explicitly grant permission to do so. You can enable/disable* collection of location information using the Android App Permissions menu.
Phone information will not be collected from your device unless you explicitly grant permission to do so. you can enable/disable collection of phone information using the Android App Permissions menu.
4. COOKIES
We do not use cookies within the App.
5. USES MADE OF THE INFORMATION
Any of the information we collect from you may be used in any of the following ways:
5.1. To prepare aggregated reports on the performance of wireless devices/Smartphones that include data from Tests that you complete. It is not possible to identify individual users in aggregated reports.
5.2. To review the performance of your wireless device/Smartphone relative to others for the purpose of identifying whether the Test results are faulty and therefore not suitable for inclusion in aggregated reports
5.3. Third Party Apps and Sites. You are able to connect your Spirent Umetrix account to third party accounts, for example by signing in with Facebook, or by posting or sharing with such third-party sites, such as Facebook, Twitter, and Instagram. BY CONNECTING YOUR SPIRENT UMETRIX ACCOUNT TO YOUR THIRD-PARTY ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD-PARTY SITES). IF YOU DO NOT WANT INFORMATION ABOUT YOU, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE. You may disconnect your account from a third-party account at any time. We may help you disconnect your account from third-party websites if you contact us.
5.4. We do not track user activity over time and across third-party Web sites or online services and as such we do not respond to “DO NOT TRACK” signalling or other messages.
5.5. We partner with Microsoft to act as our Umetrix.com identity provider, and all Spirent Umetrix users will be subject to Microsoft’s live.com privacy policy which is available at: https://privacy.microsoft.com/en-us/PrivacyStatement
6. DISCLOSURE OF YOUR INFORMATION
6.1. We do not sell, trade or otherwise provide to outside parties your personally identifiable information (PII). This does not include trusted third parties who assist us in operating our website, conducting our business or servicing you, so long as those parties agree to keep your information confidential.
6.2. We will share personal information with third party companies, organizations or individuals outside of Spirent Umetrix if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to: (a) meet any applicable law, regulation, subpoena, legal process or governmental request; (b) enforce applicable Terms, including investigation of potential violations; (c) detect, prevent, or otherwise address fraud, security or technical issues; or (d) protect against harm to the rights, property or safety of Spirent Umetrix, our users, clients, or the public as required or permitted by law.
6.3. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business, Spirent Umetrix, or Spirent Umetrix to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.
6.4. Non-PII may be released publicly or to third parties.
7. WHERE WE STORE YOUR PERSONAL DATA
7.1. All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Sites, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
7.2. We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your personal information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through Spirent Umetrix are not encrypted, and we strongly advise you not to communicate any confidential information through these means.
7.3. We will collect and store personal data on your Device using application data caches and browser web storage (including HTML 5) and other technology.
8. YOUR RIGHTS
8.1. You have the right to ask us not to process your personal data for marketing purposes.
8.2. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. 9. ACCESS TO INFORMATION

10. CHANGES TO PRIVACY POLICY
10.1. Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your consent in accordance with applicable law. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of privacy policy changes).
